By downloading, installing, or using Ice Cream Social ("the App") you agree to these Terms, which form a legally binding agreement between you and Optimistic Media LLC. Our Privacy Policy is incorporated into these Terms by reference.
The App is intended for users 18 years of age and older. By using the App you represent that you meet this requirement. If we learn a user does not, we may terminate the account and delete its data.
Ice Cream Social lets you:
You are responsible for keeping your credentials confidential and for all activity under your account, and you agree to provide accurate information. Your display name is separate from your legal name, can be changed anytime in the App, and your real name is not publicly displayed.
You agree not to:
We have zero tolerance for discrimination or harassment of any kind. Violations may result in content removal, account suspension, or a permanent ban.
Harassment includes threatening, abusive, or unwanted messages; bullying, intimidating, or stalking on or off the platform; doxing; sextortion or blackmail; repeatedly contacting a user after being asked to stop; and submitting false or malicious reports.
Discrimination includes content promoting hatred, bigotry, or violence; harassment based on race, ethnicity, nationality, religion, gender identity, sexual orientation, disability, body type, age, immigration status, caste, or health status; slurs or hate symbols; and encouraging others to engage in such behavior.
Use the in-app block and report tools; we review all reports and take swift action, and we cooperate with law enforcement in cases of immediate danger. Ice Cream Social is not a place for hate.
We maintain a strict zero-tolerance policy toward any content or behavior that endangers, exploits, or sexualizes minors. This policy is absolute and non-negotiable, and violations result in immediate permanent termination, reporting to law enforcement, and reporting to NCMEC.
Prohibited conduct includes posting, sharing, distributing, or soliciting child sexual abuse material (CSAM); grooming or sexual communication with minors; soliciting, producing, or distributing sexually explicit content involving anyone under 18; arranging in-person contact with a minor for exploitation; and human trafficking or sexual exploitation involving minors.
We cooperate fully with law enforcement and comply with the PROTECT Our Children Act. Report suspected violations to the NCMEC CyberTipline at www.missingkids.org or 1-800-843-5678, or to us at support@geticecreamsocial.app.
You retain ownership of the content you post and grant Optimistic Media LLC a non-exclusive, royalty-free, worldwide license to use, display, and distribute it within the App. You are solely responsible for your own content, and we may remove content that violates these Terms without notice.
We provide block and report tools for Terms violations and harmful behavior. We review all reports and may remove content, warn, suspend, or permanently ban accounts depending on severity. False or malicious reports also violate these Terms.
We use the Google Places API for location-based ice cream discovery. Enabling location constitutes consent to collect and use your location per our Privacy Policy; you can disable it anytime in your device settings.
Your use of the App is governed by our Privacy Policy, incorporated here by reference. We do not sell your personal data to third parties.
You can delete your account anytime in Settings; your account is deactivated immediately and all personal data is permanently removed within 90 days unless required for legal or security purposes. You may also contact support@geticecreamsocial.app from your account's email address.
The App is provided "as is" and "as available," without warranties of any kind to the extent permitted by law. We do not conduct criminal background checks on users and are not responsible for user conduct on or off the platform; the App is not a substitute for your own safety judgment when interacting with others. To the maximum extent permitted by law, Optimistic Media LLC's total liability will not exceed the amount you paid us, if any, in the past 12 months.
You agree to indemnify and hold harmless Optimistic Media LLC and its officers, employees, and agents from any claims, damages, or expenses arising out of your use of the App, your content, or your violation of these Terms.
We may suspend or terminate your account at any time for violating these Terms. Violations of our Child Safety, Anti-Discrimination, or Anti-Harassment policies may result in immediate permanent termination without warning. You may terminate your account at any time through the App.
These Terms are governed by the laws of the United States and the State of Colorado, without regard to conflict-of-law principles. Any disputes will be resolved in the state or federal courts located in Colorado.
We may update these Terms from time to time. Material changes will be notified via the App or by updating the "Effective" date above. Continued use after changes take effect constitutes acceptance.
