IceCreamSocial – Terms and Conditions

By downloading, installing, or using IceCreamSocial (the "App"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree, do not use the App. These Terms form a legally binding agreement between you and Optimistic Media.

You must be at least 18 years of age to use IceCreamSocial. By using the App, you represent and warrant that you meet this requirement. If we discover that a user is under 18, we will immediately terminate their account and permanently delete their data.

Your display name is separate from your legal name and may be changed at any time within the App. Your real name is not publicly displayed to other users.

If you encounter harassment or discriminatory behavior, please use the in-app block and report features immediately. We review all reports and take swift action. In situations involving immediate danger, we will cooperate with appropriate law enforcement authorities.

IceCreamSocial is not a place for hate. Every user deserves to participate in our community free from fear, abuse, and discrimination.

7. Child Safety and Zero-Tolerance Anti-Exploitation Policy

IceCreamSocial maintains a strict zero-tolerance policy toward any content or behavior that endangers, exploits, or sexualizes minors. This policy is absolute and non-negotiable.

The following conduct is strictly prohibited and will result in immediate and permanent account termination, reporting to law enforcement, and reporting to the National Center for Missing & Exploited Children (NCMEC):

We cooperate fully with law enforcement agencies in the investigation of any suspected child exploitation. Optimistic Media complies with all applicable federal and state laws, including the PROTECT Our Children Act, and will report suspected violations to NCMEC's CyberTipline at www.missingkids.org or 1-800-843-5678.

8. User-Generated Content

You retain ownership of content you post on IceCreamSocial. By posting content, you grant Optimistic Media a non-exclusive, royalty-free, worldwide license to use, display, and distribute that content within the App. You are solely responsible for the content you post. We reserve the right to remove any content that violates these Terms without notice.

9. Blocking and Reporting

IceCreamSocial provides tools to block and report users who violate these Terms or engage in harmful behavior. We review all reports and take appropriate action, which may include content removal, account warning, suspension, or permanent ban depending on severity. We encourage users to actively use these tools to keep our community safe. False or malicious reports are also a violation of these Terms.

10. Location Services

IceCreamSocial uses Google Places API to provide location-based ice cream discovery features. By enabling location services, you consent to the collection and use of your location data as described in our Privacy Policy. You may disable location services at any time through your device settings, though this may limit certain App features.

11. Privacy and Data

Your use of IceCreamSocial is governed by our Privacy Policy, incorporated into these Terms by reference. We comply with applicable data protection laws, including the EU General Data Protection Regulation (GDPR) and the California Consumer Privacy Act (CCPA/CPRA), where they apply to you. We do not sell your personal data to third parties.

12. Account Deletion and Data Retention

You may delete your account at any time within the App under Settings. Upon deletion, your account is deactivated immediately and all personal data is permanently removed from our systems within 90 days, unless retention is required for legal or security purposes. You may also request deletion by contacting with the email address associated with your account.

13. Disclaimers and Limitation of Liability

IceCreamSocial is provided "as is" without warranties of any kind. Optimistic Media does not conduct criminal background checks on users and is not responsible for user conduct on or off the platform. To the fullest extent permitted by law, Optimistic Media's total liability shall not exceed the amount paid by you, if any, in the past 12 months. We are not a substitute for your own safety judgment when interacting with others.

14. Indemnification

You agree to indemnify and hold harmless Optimistic Media, its officers, employees, and agents from any claims, damages, or expenses arising out of your use of the App, your content, or your violation of these Terms.

15. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms. Violations of our Child Safety, Anti-Discrimination, or Anti-Harassment policies may result in immediate permanent termination without warning. You may terminate your account at any time through the App.

16. Governing Law

These Terms are governed by the laws of the United States and the State of Colorado, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in the State of Colorado.

17. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via the App or email. Continued use of the App after changes take effect constitutes your acceptance of the revised Terms.
